HOS rules are the service hours, that is, the maximum amount of time a driver can spend driving a commercial vehicle. This time naturally includes both rest time and hours for driving itself. All HOS rules are detailed in 49 CFR 395.

Violation of HOS rules as an O/O is something that many commercial vehicle drivers abuse. It seems to them that such violations do not entail anything dangerous, but this is not the case. As a serious preventive measure, large fines, deprivation of a license, as well as a reduction in the reduction of the CSA score can act. Not to mention that by violating the HOS rules, you are simply putting yourself and other road users in danger.

Penalties for violations of the HOS rules can be:

  • Suspension from the possibility of driving a truck for a certain period;
  • Fines of various sizes from state or local authorities;
  • Fines of various sizes for the transport company where the truck driver works. The size can reach from 1000 to 11000 dollars;
  • Reduction of the driver's personal safety rating in the public database;

CR England and CRST companies are not only engaged in cargo transportation but have also provided training services for truck drivers for a long time. Both have popularity and reputation, but which one to choose?

As for CR England, the history of this company goes back to 1920. Now they own five driving schools and help them with further employment in their company. CRST, in turn, is a freight company in Iowa, which also owns auto schools for large transport, but since 1955.

Both companies will pay for your training if you are guaranteed to work for them for one year later (that is, fulfill debt obligations, which may vary). Most drivers suggest choosing CRST, however, provided there are no serious criminal records. If you have a history of crimes or violations, then CRST will reject you more likely. But they have another plus besides the quality of training - a higher fee (0.42 cpm instead of 0.14 cpm offered by CR England).

Naturally, the choice is yours. You can personally ask drivers who have been trained in one of these companies. We have only provided the data obtained during our own mini-study. Both companies have a good reputation and a lot of positive reviews.

Does anyone know how much a ticket in NY state will cost for my ELD not working properly? The officer couldn't download off my phone i didn't have instructions in operating my ELD. Basically, my hardware (ELD) wasn't showing me driving but I was on duty status.

You might have to pay a hefty fine for your ELD not working properly. The DOT requires you to have a functioning ELD that can be downloaded by an officer and to have instructions on how to operate it. If you don’t, you could be cited for violating the ELD rule and falsifying your logs. The fine amount depends on the severity of the violation and the state you’re in, but it could range from hundreds to thousands of dollars.

You might be able to avoid a ticket if you can prove that your ELD malfunctioned and that you tried to fix it or report it. The DOT allows you to use paper logs or an electronic logging app as a backup if your ELD stops working, but you have to keep them for eight days and show them to an officer. You also have to contact your carrier and get your ELD repaired or replaced within eight days. If you can show evidence of these steps, you might get a warning instead of a ticket.

You have to check your vehicle for any defects or problems that could affect its safety or performance. You also have to write a report and list any issues you find or that were reported to you. You have to give the report to your carrier and they have to fix the problems before you drive again. Don’t skip the post trip, it could save your ass.

If your home time starts tomorrow, but you are 12 hours away, and your managers want you to bring the cargo, then you need to figure out how to proceed. To begin with, you should understand that without a preliminary plan, you have the full legislative right not to make a trip, so if the company has not provided you with a plan, you should not move. If they provide you with a preliminary plan, then you should think about the rules for using home time.

Home time is the movement of a truck for personal use during non-working hours. The driver can count the time spent driving a CMV for personal transportation as non-working only if the driver is relieved of work and any responsibility for the performance of work by his supervisors.

The new legislation divides home time and working time when driving a commercial vehicle. Using home time for transportation is illegal, whether a preliminary plan is presented to you or not. Here the driver has every right to refuse transportation, referring to the legislation.

There may also be an interpersonal issue between the management and the driver. If the management insists and is not afraid of the legislation and cannot realize the danger of abandoning home time - it is worth stopping being afraid to work in such a company. If you understand that the current situation occurred due to the fact that you unsuccessfully chose the home time for yourself, then proceed as follows. For example, if you need to come home on the 12th, then ask for home time for 10. Always choose this time with a margin so that you will not be sent to carry the cargo for some short time before home time.

Despite a lot of changes in legislation and improved conditions for commercial vehicle drivers, many managers still use similar tricks with home time to keep you carrying 1 more cargo, thereby reducing your additional time for rest. Therefore, you must learn to anticipate such situations and take home time in advance and 1-2 days before the desired date. This is especially true of situations with family holidays and weekends. For example, your wife has a birthday, and you want to be at home on this holiday and decide to take a day off specifically on this day. And 12 hours before your home time, your boss will send you to carry a new cargo. This way, you will lose some of your home time, which is illegal, but ignored by many carriers.
