In July 2022, Erin Barton, the widow of Billy Barton II, a dump truck driver who lost his life in a tragic accident, filed a lawsuit against BNSF, the owner of the train track. The incident occurred in June 2022 in Missouri, and the lawsuit claims that the steep incline, lack of warning devices, and poor visibility due to overgrown brush caused the accident. According to ABC 17, the train was traveling at 87 mph when it collided with Barton's truck, resulting in the deaths of three train passengers and injuries to 150 others. The lawsuit alleges that BNSF is responsible for the accident and that their negligence caused the loss of life and injuries.

The wrongful death lawsuit has been scheduled for trial starting October 28th, 2024. Barton hopes that justice will be served for her husband's untimely death and that this tragedy will serve as a wake-up call for train track owners to prioritize safety measures and maintain their tracks.

This accident is a somber reminder of the importance of safety measures in the transportation industry. It is crucial for companies to prioritize safety and ensure that their employees and the public are protected from accidents and injuries. The upcoming trial will shed light on the events leading up to this tragedy and hopefully bring some closure to those impacted by the accident.
